LAWSUIT OVER MAY ELECTION DATE DISMISSED

A lawsuit filed last month over moving the date of next week’s local election in Augusta was dismissed Tuesday.

The suit, which was filed by the American Civil Liberties Union, Representatives Gloria Frazier, Henry Howard, Ernest Smith and several others, contended that moving the local elections from the November general election ballot to next week’s primary violates the voting rights act.

The lawsuit claimed minorities were much less likely to go to the polls on the earlier date than if the election were held in November.

U.S. District Judge Randall Hall denied the request for an injunction to block next week’s election and dismissed the suit yesterday.
